The US Securities and Exchange Commission (SEC) opposed the request to dismiss the appeal submitted to the court by Ripple.
“The SEC, like the court, has an institutional interest in the final resolution of this case in the most efficient manner,” the agency said. On the other hand, the defendants want to delay the final solution and thus gain benefits by continuing to sell XRP freely on public exchanges.” said.
What happened?
As it is known, the case between Ripple and the SEC, which has been going on for more than two years, was decided last month and the court ruled that the sales of Ripple's token, XRP, on the stock exchanges do not qualify as an investment contract. This decision was a significant defeat for the SEC. Following the decision, the SEC petitioned the court and asked for permission to appeal. Ripple recently wrote to the court stating that this application should be rejected.
Ripple decision also spurred LBRY into action
On the other hand, the court's partial finding that Ripple was right also increased LBRY's hopes. LBRY was another project that the SEC filed a lawsuit against in 2021. LBRY, which lost this case, decided to appeal after the Ripple decision. The company made its official application on the subject on Thursday.
